The General Data Protection Regulation (GDPR)
Since May 2018, the General Data Protection Regulation has been the European framework for the processing and movement of personal data. This personal data protection policy tells you how EDII processes your personal data, in compliance with the GDPR.
Retention of your personal data
For the purposes of commercial prospecting, your personal data is kept for 3 years from its collection or from the last contact that went unanswered.
The personal data processed for the conclusion and management of your contract is kept in accordance with the statutory limitation periods, set according to the nature of the contract.
Disclosure of your personal data
Your personal data is processed by EDII, the data controller.
EDII is a company represented by David Dantoni, registered with the trade register of Montpellier under SIREN number 753 231 083 — ww7.bebackup.fr/ — whose registered office is at 48 Rue Claude Balbastre, 34070 Montpellier, France.
Your personal data may be passed to the staff responsible for concluding, managing and performing contracts, as well as to sales staff.
Purposes for which your personal data is processed
The processing carried out by the services of EDII have the following purposes:
- The conclusion, management and performance of your contracts.
- Client management and commercial prospecting.
- Compliance with the legal, regulatory and administrative provisions in force.
The processing listed rests on at least one of the following legitimate grounds:
- Performance of a contract to which you are a party, or performance of pre-contractual measures taken at your request. On that legal basis, refusing to provide your data makes it impossible to conclude and perform the contract.
- Compliance with a legal obligation to which the data controller is subject.
- The legitimate interest pursued by the data controller, in particular commercial prospecting and the conduct of research and development activities. That legitimate interest consists in commercial development and the development of new offerings and new services.
Where the processing rests on none of the grounds set out above, your consent to the processing will be sought.
Data collected by this site
The contact and demonstration request forms collect your name, your company, your email address, your telephone number and the content of your message. This data is used solely to handle your request and any commercial relationship that may follow.
Requests for access to the free tools collect your name, e-mail address, country, the characteristics of your device and your message. This data is used to create your access and send it to you. If access is granted, a cookie remembers your access code on your device, and downloads made with this code are recorded.
For protection against automated submissions, a non-reversible fingerprint of your IP address is recorded. The IP address itself is never stored in the clear.
Google Analytics audience measurement is only activated after your explicit consent. You can change that choice at any time using the button "Manage cookies" shown at the foot of every page.
Internal audience measurement
Independently of Google Analytics, this site keeps its own visit counters. This measurement is designed to process no data that would identify you or allow you to be tracked:
- No cookies and no identifier kept on your device.
- No IP address recorded, not even in a durable hashed form.
- So that the same visit is not counted twice in a day, a technical fingerprint is computed from a salt that changes every day: it differs from one day to the next for the same visitor, which makes any tracking over time impossible. It is deleted after 48 hours.
- All that remains is aggregate statistics per day and per page: number of page views, reading depth, type of site the visit came from, clicks on buttons.
- This data is neither passed on nor sold to any third party and serves only to improve the content of the site.
This measurement falls under the consent exemption provided by the CNIL for statistics strictly limited to measuring the site's audience, with no cross-referencing against other processing.
The rights available to you
- Right of access
- It allows you to obtain confirmation as to whether or not data concerning you is being processed, and to be given a copy of all the personal data held by the data controller.
- Right to portability
- It allows you to retrieve your personal data in a structured, commonly used, machine-readable format. This right applies only to data actively provided, for example by filling in a form, or observed during your use of a service in the course of concluding or managing your contract.
- Right to object
- It allows you to stop receiving commercial prospecting from us or from our partners or, for reasons relating to your particular situation, to stop the processing of your data for research and development purposes.
- Right to rectification
- It allows you to have information concerning you corrected where it is out of date or wrong, and to have incomplete information concerning you completed.
- Right to erasure
- It allows you to obtain the erasure of your personal data, subject to statutory retention periods. This right may apply in particular where your data is no longer necessary for the processing.
- Right to restriction
- It allows you to restrict the processing of your data in three cases: unlawful use of your data, a challenge to its accuracy, or a need for the data in order to establish, exercise or defend your rights. Your data is then no longer actively processed and cannot be changed while this right is being exercised.
- Right to obtain human intervention
- Data controllers may use automated decision-making with a view to taking out or managing your contract. In that case, you may ask the Data Protection Officer which criteria were decisive in the decision.
Exercising your rights
You may exercise your rights by post at the following address: EDII — Personal data protection — 48 Rue Claude Balbastre — 34070 Montpellier — France, or by email using the contact form of the site. In support of your request, you will be asked to prove your identity.
You may lodge general directions with a trusted third party, or specific directions with the data controller, concerning the retention, erasure and disclosure of your personal data after your death. Those directions may be changed or revoked at any time.
Should you disagree about the collection or use of your personal data, you may refer the matter to the French data protection authority (Commission Nationale de l'Informatique et des Libertés, CNIL).
